MILFORD, CT – A Milford Health Department Sanitarian stopped construction at New York Mart, 804 Boston Post Road.
The former M&M Farms site was purchased in 2015 by NYM Milford LLC and is operated by the family that operates iFresh. According to information obtained from the Milford Health Department via the Freedom Of Information Act, an inspection on June 8 disclosed the existence of a public health law violation on the premises.
The violation was the construction of a food establishment without a proper plan review approval from the Milford Health Department. According to the document, Milford Sanitarian Timothy Noia saw vehicles in the New York Mart parking lot, which led to a site visit. Peter Yang was on site, who stated he was the contractor for the job, and allowed Noia access to the establishment.
The Documents state when Noia entered the establishment, he saw it was under construction and informed Yang there was no approved plan on file with the Milford Health Department, and no construction should be taking place. A Plan review application was submitted on Nov. 9, 2021, but it was denied on Nov. 21, 2021, due to incomplete information.
The following day Noia posted a cease-and-desist order at the property and mailed a cease-and-desist to the property owner. The Documents state Noia met with Yang at the Milford Health Department, and it was reiterated to Yang that as the Milford Health Department has not issued approval for a plan review for this establishment, there shall be no construction taking place until the Milford Health Department issues a plan review.
