Eight employees are suing the Hampden County Sheriff’s Department, alleging they were not paid for their time when participating in mandatory annual physical fitness tests.
The class action lawsuit, filed Nov. 27 in Hampden Superior Court, claims that the department has an illegal policy and practice of not paying employees for the two hours required for the mandatory fitness evaluations, according to court records. The eight employees suing the department are Nicholas Kirchner, Morgan Wanzer, Jen Assad, Nicholas Moutinho, Kristopher Grimshaw, Dan Willemain, Chase LaPorte, and Chris Lempke.
The complaint states that the suit is being filed on behalf of the named employees as well as “all others similarly situated.”
