Medical provider settles $1.5M in Berkeley County medical malpractice lawsuit

BERKELEY COUNTY, S.C. (WCSC) – Medical provider Defendant Wellpath has offered a settlement of $1.5 million following a lawsuit that alleged malpractice and negligence between a former nurse at the Berkeley County Detention Center and an inmate.
The lawsuit references events from June 2017, which claimed a person was assaulted while in custody with the center and the Berkeley County Sheriff’s Office.
The person accused an employed nurse of performing unnecessary and inappropriate medical exams when they requested a non-urgent medical treatment for a minor skin infection. The lawsuit claimed the nurse continued to engage in additional conduct with patients and was employed with the center until 2018.
The lawsuit also claimed the nurse was allowed access to inmates despite an alleged knowledge of unnecessary exams.
In total, the case summoned a jury trial for six causes, including medical malpractice, negligence, gross negligence, negligence per se, negligent retention and negligent supervision.
In October 2024, Defendant Wellpath agreed to pay out a $750,000 settlement by the first of the month, and another $750,000 by the first of November.
The Berkeley County Sheriff’s Office has not responded to a request for comment.
