Assault suspect released pending autopsy after Penn Station subway death

A New Jersey man faces an assault charge after a 55-year-old man died following an altercation at a Manhattan subway station Saturday evening.
Nassadir Tate, 21, of Hillside, New Jersey, was released with a desk appearance ticket, according to Gothamist, and is scheduled to appear in court April 1. Police are waiting for autopsy results before considering additional charges.
The incident unfolded at around 7 p.m. at the 34th Street-Penn Station subway in Midtown Manhattan following a dispute between the two men. Emergency responders found the 55-year-old unconscious and unresponsive on the northbound C/E platform.
EMS transported the man to Lenox Hill Hospital in critical condition, where he later died.
Investigators charged Tate on Sunday after surveillance video showed him punching the man in the face, according to the NYPD.
Authorities did not disclose details about the dispute or how much time passed between the assault and when the man became unresponsive.
Police said Tate was not charged with homicide because the medical examiner has not yet determined the cause of death. Officials said he could not be held because he had no prior history of assault.
The deceased man’s identity has not been released pending family notification.
